These terms are an agreement between you (and the business you represent) and FUSE LLC ("FUSE", "we", "us") for use of the FUSE CRM, its apps and fusecrm.co (the "Service"). By signing up or using the Service, you agree to them.
1. The Service
FUSE is a subscription CRM for real estate wholesalers and other businesses, including sub-accounts, texting, calling, automations, AI tools, trackers and related apps. Features depend on your plan and may change as we improve the Service.
2. Accounts
You must be at least 18 and give accurate information. You are responsible for your logins, your team members' use of the Service, and keeping passwords secure. We may require identity verification before setting up your account.
3. Plans, billing and cancellation
- Subscriptions are billed monthly in advance through Stripe and renew automatically until cancelled. Setup fees, usage charges (such as texts, billed per segment sent and received, and calls) and add-ons are billed as described at checkout or on your invoice.
- Beta pricing: clients who join during the beta pay the beta price shown at checkout for as long as the beta runs. We will give you at least 30 days' notice before beta pricing ends and before any price change.
- You can cancel any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. Fees already paid are not refunded, except where the law requires.
- If a payment fails, we may retry it and may pause your account until it is paid.
4. Your messaging and legal compliance
You are responsible for every text, call and email sent from your account, and for following the laws and carrier rules that apply, including the TCPA, CAN-SPAM, the Do Not Call registry, state telemarketing laws, and A2P 10DLC registration. You must have the consent the law requires before contacting anyone, honor opt-outs promptly, and not send spam, misleading content, or content that is illegal or harmful. Carriers may filter or block messages; we do not guarantee delivery. We may pause sending from an account that puts our numbers, brand registration or other customers at risk.
5. Acceptable use
You may not use the Service to break the law, infringe others' rights, harass anyone, send malware, attempt to access other accounts or systems, scrape or resell the Service, or interfere with its operation.
6. Your data
You own the data you put in the Service. You give us permission to host, process and use it only to provide and improve the Service for you, as described in our Privacy Policy. You can export your data while your account is active.
7. AI features
FUSE includes AI tools that draft messages, reply to leads and analyze data. AI output can be wrong. You are responsible for reviewing how these tools are set up on your account and for what is sent in your name.
8. Third-party services
The Service is built on and connects to third-party services (including HighLevel, Stripe, phone carriers and others you choose to connect). Their terms apply to your use of them, and we are not responsible for their availability or actions.
9. Our property
The Service, our software, templates, workflows and branding belong to FUSE. Your subscription gives you a limited, non-transferable right to use them while your account is active. Templates and workflows we provide are locked and may not be copied out of the Service.
10. Disclaimers
The Service is provided "as is." We do not promise it will be uninterrupted or error-free, or that it will produce any particular number of leads, deals or revenue.
11. Limitation of liability
To the fullest extent the law allows, FUSE is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.
12. Indemnity
You will defend and indemnify FUSE against claims arising from your messages, your data, or your violation of these terms or the law, including claims under the TCPA or similar laws.
13. Suspension and termination
We may suspend or end your access if you break these terms, fail to pay, or create legal or carrier risk. You may stop using the Service at any time.
14. Governing law
These terms are governed by the laws of the State of Nevada. Disputes will be handled in the state or federal courts in Clark County, Nevada.
15. Changes
We may update these terms. If changes are significant, we will notify you at least 30 days before they take effect. Continuing to use the Service after that means you accept them.
